Terms and Conditions for Guests

1. Scope

These terms govern the use of Banaki by guests who book accommodation at a campsite or a comparable holiday accommodation through the platform. Banaki is operated by Kogge Digitalagentur, owner Morris Mehnert, Memellandstraße 2, 24537 Neumünster (contact details in the Imprint).

2. What Banaki is and what it is not

Banaki acts as an intermediary for accommodation. You conclude the accommodation contract directly with the campsite or accommodation you book, not with Banaki. Banaki is not a tour operator and owes you no travel service. The provisions on package travel (Section 651a BGB) do not apply, because Banaki only arranges a single service.

3. Formation of the contract

By clicking the booking button, you submit a binding offer to the host. The contract is formed as soon as the host confirms the booking, or the booking is marked as instantly confirmed. The button is labelled with the actual obligation it creates (Section 312j(3) BGB), for example "Pay now".

4. Prices and payment

The total price shown at checkout includes all mandatory fees known at the time of booking. Where a service fee applies, it is shown within the total price before the booking is completed. Payment is processed through Stripe. Banaki receives your payment on behalf of and for the account of the host. Paying Banaki discharges you towards the host: your payment obligation is settled as soon as the funds reach Banaki.

5. No right of withdrawal for the booking

There is no right of withdrawal for contracts on accommodation for a specific date (Section 312g(2) no. 9 BGB). This applies regardless of whether you book through Banaki or directly with the host.

6. Cancellation

The cancellation terms of the respective host apply, as shown to you in the listing at the time of booking. Banaki is not a party to these cancellation terms and makes no independent decision on refunds; refunds follow what has been agreed between you and the host.

7. Reviews

You can only review an accommodation after you have actually booked it there. Banaki checks technically whether your review is linked to a completed booking. This ensures that reviews come from guests who genuinely stayed at the accommodation.

8. Liability

Banaki is liable for damages arising from the use of the platform in accordance with statutory provisions, insofar as they are based on intent or gross negligence or concern material contractual obligations. The host alone is liable for the provision of the accommodation service itself, that is, for the stay on site.

9. Notice regarding traders

All providers listed on Banaki act as traders. Consumer protection provisions, in particular on the right of withdrawal, therefore apply in full between you and the host, insofar as they are not excluded under paragraph 5.

10. Changes to these terms

Changes to these terms take effect for bookings made after publication of the new version. Bookings already concluded remain subject to the version that applied at the time of booking.

11. Final provisions

German law applies. The place of jurisdiction for disputes with traders is Neumünster.
